    By the time I get to Phoenix...

    ...I'll be totally stoked for the big game.

    I am leaving New York this morning to cover the Super Bowl for Not only am I going to the game but I've been hired by Newsweek as a contributor to Mark Starr's All-Starr blog. Mark's the real sports journalist but I will be supplementing his coverage by reporting the sights and sounds of the spectacle that is Super Bowl week. If there was a "cloud 10" I'd be on it right now.

    Congrats on the press credentials. It should make life a lot easier getting through the gate (and if the credentials don't get you a seat near the 50-yard-line, hopefully, you'll be at towards the north end of the field, since the replay board at the south end is a lot bigger, and the mountains behind the south end window will provide a nice diversion to look at if the Giants are losing on Sunday).

    Does anyone know if Olby will be attending? Perhaps Mr Cox could get an interview with His Lordship.

    Federal Law - The Computer Fraud and Abuse Act.

    The FBI has initiated a federal investigation into the recent DDOS attacks. In the event of indictments, the hackers will be prosecuted under the Computer Fraud and Abuse Act, Title 18, United States Code Section 1030 (the “CFAA”). Subsection (5)(A) of the CFAA makes it a crime to,

    a. knowingly causes the transmission of a program, information, code, or command, and as a result of such conduct, intentionally causes damage without authorization, to a protected computer.

    This definition would seem to apply to both IP and e-mail spoofing. A protected computer is very broadly defined as a computer,

    b. exclusively for the use of a financial institution or the United States Government, or, in the case of a computer not exclusively for such use, used by or for a financial institution or the United States Government and the conduct constituting the offense affects that use by or for the financial institution or the Government; or
    which is used in interstate or foreign commerce or communication.

    The penalty for violating the CFAA is a maximum five years in prison and a minimum six-month incarceration for each offense. Repeat offenders can face a maximum 10-year prison term and fines ranging from $250,000 to twice the gross losses incurred by the victims. Significantly, the law also allows those affected to file civil suits against their attackers.

    WASHINGTON — U.S. Sen. Jim DeMint, R-S.C., says the City of Berkeley, Calif., no longer deserves federal money.

    DeMint was angered after learning that the Berkeley City Council voted this week to tell the U.S. Marine Corps to remove its recruiting station from the city's downtown.

    "This is a slap in the face to all brave service men and women and their families," DeMint said in a prepared statement. "The First Amendment gives the City of Berkeley the right to be idiotic, but from now on they should do it with their own money."

    "If the city can’t show respect for the Marines that have fought, bled and died for their freedom, Berkeley should not be receiving special taxpayer-funded handouts," he added.
